WVa State trooper still facing domestic battery charge, burglary charge dismissed
FAYETTEVILLE, W.Va. (WVVA) - A felony burglary charge against a West Virginia State trooper is dismissed.
Trooper James Fox was arrested in Wyoming County on both the burglary charge and a domestic battery charge.
The case was transferred from Wyoming to Fayette County to avoid a conflict of interest. A special prosecutor was also assigned to the case from Raleigh County, Brian Parsons.
At a preliminary hearing on the matter on Monday, a Fayette County magistrate found there was not enough evidence to move forward on the burglary charge. The domestic battery charge still stands.
