Man who died at Raleigh County coal mine was under indictment for murder

FAYETTE COUNTY, WV (WVVA) -

A Fayette County man who died in a mining accident on Wednesday was under indictment for first degree murder.

James A Whitlock, 38, of Smithers, was killed while performing electrical work on a highwall miner at the Pocahontas Coal Company's Devils Fork 2 highwall mine. He worked for Bundy Auger Mining, Inc. at the time. Click here for more information on the fatal mining incident.

According the Fayette County Prosecuting Attorney's Office, Whitlock was under indictment for the October 2016 shooting death of Clark "Jake"  Hartwell, 33. The shooting took place in the parking lot of a Montgomery, WV convenience store. Click here to read a previous report. 

A grand jury indicted Whitlock in September of last year. He was out on bond at the time of his death. The charges will now be dismissed.
