Charges dropped against man in Bluefield officer's death

MERCER COUNTY, WV (WVVA) -

Charges have been dismissed against one of two men charged in connection with the death of a Bluefield, WV police officer.

Lt. Aaron Crook was killed on May 30 during a multi-vehicle crash during a possible DUI pursuit.

The charges against Morgan Smith Walker, 27, of Princeton were dismissed Thursday in Mercer County Circuit Court.

Walker, along with Joseph Smith, 24, were both indicted in October on charges fleeing an officer resulting in death, fleeing while driving in an impaired state, obstructing, and driving while impaired causing death. 

"The body-cam footage taken during the traffic stop shows that Morgan Walker could not have been the driver of the fleeing vehicle," said Prosecuting Attorney George Sitler. "Walker's admissions to being the driver were false. At the time he made them, Walker was severely intoxicated."

According to Sitler, Walker was originally charged because "investigating officers had compelling reasons to believe he was the driver." The vehicle was also registered to Walker.

Charges are still pending against Joseph William Smith. He's currently being held in Southern Regional Jail without bond. A trial date is set for January 16 in front of Circuit Court Judge Mark Wills.
