No criminal act committed; special needs student injured at Melrose Elementary

MERCER COUNTY, WV (WVVA) Investigators have determined that a Mercer County teacher and her aides did not commit any criminal acts in a case involving two special needs children back on May 27.

According to a the report made by Sergeant S. A. Sommers with the Mercer County Sheriff's Office, two aides were outside with other students on recess at the time a student allegedly attacked another student in a special needs classroom at Melrose Elementary School. The special education teacher was in the classroom at the time of the altercation, but was distracted by a student trying to leave the room. Surveillance footage of the hallway outside the classroom supports the teacher's statement. The teacher told Sommers she did not witness the attack. According to the report, “she [the special education teacher] observed that the victim had fell off of the beanbag chair and when she got to her to lift her she found the injuries. She also stated that she did not see the other student attack the victim or hear a commotion but assumed it was him."
