Sen. Manchin says appeals court dismissed EPA lawsuit over technicality

Washington, D.C. – Today, U.S. Senator Manchin (D-WV) released a statement on the United States Court of Appeals for the D.C. Circuit ruling that lawsuits from a coalition of states and energy producers challenging the Environmental Protection Agency's (EPA) proposed carbon emissions rule must wait for the final rule later this summer before challenging it in court.

“More than ever before, the overreach of the EPA is taking a toll on West Virginia and other energy-producing states across our nation, and I am disappointed that the court was forced to dismiss this case because of a technicality,” Senator Manchin said. “It's clear that the EPA plans to make this rule final later this summer, and when it does, I am confident that the court will legitimately find that the Administration greatly exceeded its legal boundaries with this destructive rule. This decision by the court also indicates that it is time for Congress to step in and stop these regulations from going into effect. As we await the EPA's final rule, I urge my colleagues to act immediately to move legislation that will rein in these harmful EPA regulations.”
