McDowell County man is sentenced for 1981 shooting death of his father

 MCDOWELL COUNTY (WVVA) A convicted sex offender who is currently serving time for incest and sexual assault is sentenced for the shooting death of his father more than three decades ago.

This past January, David Miller, 54, entered a guilty plea to voluntary manslaughter for the December 7, 1981 shooting death of Hobert Miller. He was sentenced on Thursday to 1-5 additional years in prison. He was originally indicted on a second degree murder charge.

Prosecutors reopened the case after a female family member named Jenefer Crim came forward claiming that David Miller sexually assaulted her in the 1980's when she was 14 years old. The victim also told investigators she witnessed the shooting death of Hobert Miller. At the time, David Miller claimed the shooting was in self-defense.

David Miller was sentenced in November to 2-10 years in prison for incest and 5-10 years for sexual assault.

"December 7, 1981 is a date that is forever tarnished with the memories of witnessing daddy being murdered. David said in court today[Thursday] that he wishes he could take it back and I could not help and I couldn't help but wonder what part he wishes he could take back? Was it the choice he made to walk in the house and pick up a gun and shoot daddy or was the part where he stood over his dead body lying covered in blood in the the kitchen floor as he poked him with the barrel of the shot gun saying "Get up ole man, come on - get up! You aren't so big and bad now are you?," says victim Jenefer Miller Crim. "1 to 5 years in exchange for a human life is NOT justice but thanks to the efforts and dedication to justice of former prosecutor Sid Bell, current prosecutor Ed Kornish and investigator Mike Spradlin our family finally has closure and can begin to travel a path toward healing."
