Doctor won't have to register as sex offender after putting tongue in elderly patient's mouth

A Roane County doctor will no longer have to register as a sex offender after sticking his tongue in an elderly patient's mouth, which the patient then bit off.

The West Virginia state Supreme Court upheld the battery conviction against Dr. Kenneth Seen of Spencer, but set aside a finding that he was sexually motivated.

Seen was sentenced to probation in 2013 in Roane County Circuit Court. He was originally ordered to register as a sex offender for 10 years.

The high court said prosecutors denied his due process rights by failing to give a required pretrial notice of its intent to seek a finding of sexual motivation.
