A man is dead after Troopers say they were forced to shoot him, after he pointed his gun at them.

KEYSER (WVVA)-A man is dead after Troopers say they were forced to shoot him, after he pointed his gun at them.

According to Lieutenant Michael Baylous with West Virginia State Police, Troopers at the Keyser Detachment responded to a call alleging that Harvey Oates, 42, was distraught and had a gun.

The call came in around 11:00PM on Friday. Baylous says the Troopers were familiar with Mr. Oates and were aware that there were outstanding warrants for his arrest.

While responding to the call, a Trooper says he observed Oates driving on Horseshoe Run Road. When the Trooper attempted to initiate a traffic stop, Mr. Oates fled and a short pursuit began. Troopers say Oates ran his vehicle off the road, jumped out of the car and threatened to shoot the Troopers as well as himself.

According to Baylous, Troopers negotiated with him for approximately an hour and a half, before he became extremely agitated.

At that point Troopers say Mr. Oates began moving toward the Troopers in defiance of their repeated commands to stop and drop the weapon.

As he continued to move closer to the Troopers, he aimed his weapon at one of them. The Trooper says he was forced to use his gun in response.

Mr. Oates died as a result of his wound.
