State Trooper will not be charged in a fatal shooting of a Mercer County man

 MERCER (WVVA) – West Virginia State Senior Trooper B.D. Gillespie will not be charged in the fatal shooting of a Mercer County man.

According to the Associated Press, after weighing the evidence in the shooting of 18-year-old Timothy Hill on Thursday, a grand jury did not return charges against Gillespie.

The shooting happened back in June after Gillespie's wife saw three men in their driveway tampering with their vehicles.

A state police news release that WVVA obtained back in June states, Gillespie attempted to take Timothy Hill into custody and that's when a fight ensued.

The release says Hill attempted to disarm Gillespie, who was able to regain control of the weapon.

Police said Gillespie fired two shots at Hill, fatally wounding him.

Gillespie was in uniform during the shooting.
