McKinley murder conviction, life sentence upheld by WV Supreme Court

The Supreme Court of Appeals of West Virginia has announced its ruling in the case of Marcus McKinley.

Writing the opinion was Chief Justice Robin Jean Davis.  Chief Justice Davis affirmed the judgment convicting McKinley of first degree murder and sentencing him to imprisonment for life without the possibility of parole.

A Mercer County jury found McKinley guilty without mercy in the 2011 murder of the mother of his young child.

Following the verdict, Judge Omar Aboulhosn proceeded with sentencing, giving McKinley a life sentence without parole for the shooting death of 18-year-old Ayana Patton.

The defense immediately said it planned to appeal.

Patton's body was found at the Opera House apartments in Bluefield on the morning of May 19, 2011. McKinley was apprehended that evening in the Charlotte, N.C., area.

McKinley expressed remorse in court the night of the original guilty verdict.
