FAYETTEVILLE (WVVA) -- A Fayette County bus driver pleas guilty to a sexual abuse charge, and the case has set a precedent for others of its kind.

Steven "Rick" Malay is convicted of sexual abuse by a person of trust.  His original charges stemmed from sexual encounters between him and a 14-year-old, who rode his bus, during late 2012.

The "person of trust" label was nearly dropped against Malay,  since the incidents didn't happen while Malay was in his bus driver role.  However, the West Virginia Supreme Court ruled that a circuit judge could not make that decision -- that would be left for a jury to decide.  All other cases in West Virginia will now follow suit.

Fayette County Assistant Prosecuting Attorney, Brian Parsons, believes that it was best for the victim though, that this case did not go to trial.  "It is my personal policy that I try to resolve cases in a way that prevents a child from testifying, but still exposes the defendant to enough time in prison, such that it adequately addresses the criminal conduct," says Parsons.  "I think we did that in Mr. Malay's case."

Malay is currently on home confinement with a GPS tracking bracelet.  He will be sentenced September 18, facing 10 to 20 years in prison.
