Suspects in elder abuse case appear in court

PRINCETON (WVVA) - The case against a woman charged with abuse against an elderly man in her care has been bound to the grand jury.

Patina Hypes appeared in court Friday afternoon for her preliminary hearing. Hypes and David Small are accused of beating 82-year-old Thomas Moore with several objects including a wooden spoon, belt, pots and pans.

Moore told police the abuse was punishment for his incontinence and had been occurring for approximately two weeks before he was taken to the hospital  on April 29 with multiple injuries, including a severe ear injury, black eye, busted lip and a bruised hand.

Trooper J.A. Cook testified Friday that Moore had to have reconstructive surgery on his ear. He is currently recovering in stable condition at a nursing home.

The case against Hypes will now be heard by the next sitting of the Mercer County Grand Jury.

The second suspect, Small, appeared for his hearing after Hypes and waived his time limit.
