Concord University football players back in court

PRINCETON, W. Va (WVVA)-- Three Concord University football players are back in court Tuesday.

Russell Bailey, Maricco Sanders, and Riyahd Richardson appeared before Judge Derek Swope for pretrial motions.

Each faces multiple charges after police say they went to an apartment for an apparent drug purchase and got into a fight with another person there.
Tuesday, prosecutors asked for permission to bring the victim, Brett Summers, to the stand to testify about what happened. Attorneys debated whether or not he should be granted immunity if he testifies, because defense attorneys allege he was a drug dealer prepared to sell the three players marijuana.

Prosecutors said Summers is a witness valuable to the case who could provide significant information about the ownership of a gun that was taken there, what was taken from the home, and his injuries in the alleged attack.

Defense attorneys questioned his inconsistent statements about whether or not there were drugs in the apartment at the time the crime occurred.

Judge Swope
 agreed that Summers can testify, with limited immunity. That immunity, he concluded, would only apply when Summers discussed the events involving the three defendants.
