UPDATE: Mistrial declared in Spaulding trial

PRINCETON (WVVA) - A mistrial has been declared in the case of a Mercer County man charged with sex crimes against children, after health issues arose with a juror.

The word came from Judge William Sadler's courtroom Friday evening, after a juror experienced anxiety and chest pains.

Sadler said he could not find precedent with a similar case, and the jury was dismissed.

A status hearing is scheduled for next week.

PRINCETON (WVVA) - A Mercer County jury is now deliberating the fate of a man accused of sexually abusing two children.

John Spaulding is facing a 57 count indictment, including six counts of sexual assault, one count of sexual abuse and 50 counts of possession of child pornography.

On Thursday, Spaulding took the stand in his own defense and told the jury that he purchased the laptop where State Police found the child porn, but his co-defendant, Kimberley Cox was the one who used it. 

He claimed he did not even know how to make a folder to organize files.

PRINCETON (WVVA) -- The trial continues Thursday for a man facing a 57 count indictment, including six counts of sexual assault, one count of sexual abuse and 50 counts of possession of child pornography.

Thursday, the defendant, John Spaulding took the stand.

Spaulding told the jury under oath that he purchased the laptop where State Police found the child porn, but his co-defendant, Kimberley Cox was the one who used it.  He claims he does not even know how to make a folder to organize files. 

As for what investigators found on his phone, he says that Cox would use it while they took long driving tips around the region.

When cross-examined, Spaulding also told the jury that it wasn't true when he told troopers there was a lot of porn on the computer, and he knew about it.

After closing arguments, the case will be left in the hands of the jury.

PRINCETON (WVVA) - A jury was seated and testimony began in the trial of a Mercer County man accused multiple sex crimes against children.

John Spaulding, 40, was in court for day one of his trial Tuesday before Judge William Sadler in Mercer County Circuit Court.

Spaulding faces a 57-count indictment -- including six counts of sexual assault, one count of sexual abuse and 50 counts of possession of child pornography.

Jury selection concluded Tuesday, followed by opening arguments. After that, the prosecution began calling its first witnesses.

According to the indictment against Spaulding, the sexual assault charges involve a child under the age of 12. The abuse charge involves a victim under 16.

Last week, Spaulding's defense requested a change of venue for the trial. Sadler stated at the time that a decision would be made if the court was unable to seat a jury.

38-year-old Kimberly Cox -- also charged in connection with the abuse -- was previously sentenced to 35 years behind bars.
