Former Smithers fire chief sentenced on embezzlement charges

FAYETTEVILLE (WVVA) -- The former chief of the Smithers Volunteer Fire Department is heading to prison.  Timothy Whittington was sentenced on embezzlement charges Monday morning.

Whittington asked Fayette County Judge Blake for probation, but was denied.  He will be serving one to 10 years behind bars.

An audit revealed Whittington had embezzled more than $7,000 from the department, using it to pay his personal financial obligations.  He plead guilty to the embezzlement.

Whittington has returned $4,000 to the fire department and was ready to pay the balance of the restitution in court.  He also apologized for his actions in front of Judge Blake, but Blake said despite the restitution and apology, Whittington must suffer the consequences because he abused a position of trust. 

The former chief had served on the Smithers Volunteer Fire Department in some capacity from 1974-2012.
