Kanawha prosecutors takes over Tennis Maynard murder case

Tennis Maynard has been indicted on first-degree murder, attempted first-degree murder and fleeing charges in connection with the shooting death of former Mingo County Sheriff Eugene Crum.

Now Kanawha County Prosecutor Mark Plants will now prosecute the case.

Mingo County Prosecutor Michael Sparks withdrew from the case a few weeks ago and is now named in the latest corruption case against suspended Mingo County Judge Michael Thornsbury.

Plants says he won't have to start from scratch with the case as plans to get up to speed with the details as soon as possible.

"In every case there are going to be potential defenses. What is going to be difficult in this case is I'm going to guess there is going to be a variety of defenses that can be thrown out there that can be obstacles to the prosecution.  I'll know more about the case and it's entirety once I review the file and know the evidence," says Plants.

A December trial date for Maynard has been set.

Plants says he plans to be ready.  If not, he'll ask for a continuance.

He adds it's too early to talk about a possible change of venue.
