Couple charged in toddler's death among Raleigh indictments

BECKLEY (WVVA) - A mother and stepfather accused in the death of a toddler are among those who have been indicted by a Raleigh County Grand Jury.

A total of 89 indictments were handed down during the May sitting of the Grand Jury.

Those indicted include James Green and Brandy Smallwood. Green, 24, of Fairdale, is charged with first-degree murder and death of a child by child abuse -- among other related charges -- in connection with the Feb. 8 death of 2-year-old Grayden Morgan at a residence in the Fairdale area.

According to the criminal complaint, police said the child's injuries were consistent with him being grabbed, squeezed and punched.

Smallwood, 28, also of Fairdale, is charged with death of a child by child abuse, child abuse resulting in serious injury, child neglect resulting in death and child neglect resulting in serious bodily injury.

Also indicted on first-degree murder charges are Dominic Paige, 23, and 18-year-old Lavonte Paige. Both are accused in the shooting death of 54-year-old Danny Kennedy of Beckley in Nov. 2012.

Kennedy was shot to death outside his home on Cohen Street following an argument that apparently ensued after the suspects attempted to turn their vehicle around in the victim's driveway.

Lavonte Paige was a minor at the time of the incident.

Also arrested in connection with Kennedy's death was 28-year-old Antonio Wade. Wade has been indicted a charge of being a felon in possession of a firearm.

In another child abuse case, Joseph Hailey III is charged with child abuse with serious risk of bodily injury or death, child neglect with risk of death, and false information regarding child's injuries.

According to's previous report, Hailey was arrested last June for allegedly forcibly picking up his four-month old infant and throwing the baby between a wall and bed.

The baby suffered head injuries but was later released from the hospital and placed into custody of Child Protective Services.
