WV House Judiciary Committee discusses voiding marriage

CHARLESTON, W.Va. (AP) -- The West Virginia House Judiciary Committee spent much of their meeting trying to sort out laws on voided marriages that delegates from both parties called archaic.

Currently in West Virginia you can void a marriage if either party was insane or an imbecile at the time of the marriage.

Amid giggles, the committee adopted an amendment Thursday changing that language to legally incompetent.

Del. Stephen Skinner proposed scrapping the entire section on voided marriage, saying that marriage should be cherished and promoted. He called the concept of voided marriage repugnant. His amendment was defeated.

Del. Doug Ellem proposed eliminating the option of voiding a marriage if one party is a felon, saying felonies are more common today than they used to be. That amendment was also defeated.
