OAK HILL (WVVA) - The case against a Fayette County school bus driver accused of sexual assault is moving forward in the legal process.
Wednesday morning 54-year old Steven "Rick" Malay waived his preliminary hearing, sending the case to the grand jury.
The criminal complaint indicates Malay went to a 14-year old female student's home late at night on two occasions where they had sex.
Malay admits going to the girl's home but denies having sex with her.
A spokesperson for Fayette County Schools says Malay is still employed, but steps have been taken to ensure he has no contact with children while the case is in court.
