UPDATE: Suspects in toddler's death waive prelim hearings

BECKLEY (WVVA) - The mother and stepfather of a toddler killed after an apparent case of abuse appeared in court Tuesday morning.

Brandy Smallwood, 27, and James Green, 23, both waived their right to a preliminary hearing in exchange for open file discovery -- which means the defense will have access to the prosecution's files.

Green is charged with first-degree murder in the death of two-year-old Grayden Morgan.

Smallwood is charged with child neglect resulting in death.

The child died at a Charleston hospital on Feb. 9, after apparently suffering trauma at a home in the Fairdale community while in the care of Green.

The criminal complaint against Green stated the child's life-ending injuries 'were consistent with him being grabbed, squeezed, shaken and punched.'
