RICHLANDS (WVVA) - Prosecutors in Utah will seek the death penalty against Nathan Sloop, the step-father charged in the brutal murder of 4-year old Ethan Stacy.
Ethan's biological father is from Tazewell County. He was staying with his biological mother, Stephanie Sloop, and her husband for the summer in 2010 when he was murdered.
He had been with the couple in Utah less than two weeks.
Nathan, 33, and Stephanie, 29, are both charged with capital murder.
Ethan's body was found buried near Powder Mountain in Weber County, Utah, wrapped in garbage bags.
Police say Nathan Sloop attempted to disfigure Ethan's face with a hammer so he could not be identified.
Stephanie Sloop is expected back in court on Friday.
