PRINCETON (WVVA) -Murder charges are dropped for the wife of a man who was fatally shot while trying to rob a convenience store.
31-year-old Jessica Roberts was charged with murder, armed robbery and conspiracy in connection with an August 2011 incident at the Pop Shop in Bramwell.
Investigators say Roberts waited in the car while her husband, David, tried to rob the convenience story. He was shot dead by a customer inside the story who was carrying a concealed weapon.
The state dismissed murder charges in a court hearing on Monday in Princeton.
The court has ordered a competency evaluation on Roberts before further trial.
Roberts next court appearance will be for a bond reduction hearing on December 3rd at 9:30 a.m.
The state will investigate conditions of possible bond conditions.
Pre-trial is set for January 7th at 3:30 p.m.
