Prosecutor Removes Himself from McKinley Case

PRINCETON (WVVA) - The trial of a Mercer County man accused of murdering the mother of his young child is now delayed until early 2013.

Marcus McKinley of Mercer County is charged with murder in the May 2011 shooting death of 18-year-old Ayana Patton. Patton was found dead in her Bluefield apartment.

Just one week after McKinley turned down a plea deal in court, Prosecuting Attorney Scott Ash recused himself from the case.

Ash recused himself due to a conflict of interest. In 2004, Ash briefly served as McKinley's court appointed defense attorney.

Ash represented McKinley who was charged with a misdemeanor gun charge at the time.

Judge Omar Abouhosn said the court has submitted a request to the West Virginia Prosecuting Institute for a new prosecuting attorney for the case.

The next hearing date is set for March 19th, 2013.
