Virginia AG campaigns for eminent domain amendment

NORFOLK, Va. (AP) -- Virginia Attorney General Ken Cuccinelli is campaigning in favor of a proposed constitutional amendment that would make it harder for governments to take private land.

Cuccinelli appeared at a Norfolk business fighting the condemnation of its property near Old Dominion University.

The amendment would restrict the government's power of eminent domain by allowing the taking of property only for public use, not for the purpose of private economic development that is deemed to benefit the public. The measure was prompted by a 2005 U.S. Supreme Court ruling allowing government to seize property for private development.

Supporters of the amendment say it protects individual property rights.

Opponents say it will make the costs of public projects more expensive for state and local governments. The proposal will appear on the November ballot.
