McDowell prosecutor handling indictment of Greenbrier Co. commissioner

LEWISBURG (WVVA) - McDowell County's prosecuting attorney has been appointed special prosecutor in the case against a Greenbrier County commissioner who's accused of wrongdoing in the sale of a vehicle.

The Greenbrier County Prosecuting Attorney's Office announced in a press release Friday that it is not involved in the case against Commissioner Michael McClung, due to a conflict of interest.

"My office made no decisions regarding this presentation of this matter to the grand jury and will play no role in any decision regarding the prosecution of the indictment returned against Mr. McClung," Greenbrier County Prosecuting Attorney Patrick Via said.

McClung is accused of selling a 1999 model Ford Expedition to Charles Scott for $3,000 but only reporting it for $1,000, which allegedly defrauded the State of West Virginia tax revenue money from the sale of the vehicle.
