Man fatally shot in Bluewell cemetery

BLUEWELL (WVVA) - A Colorado man was fatally shot by a State Trooper after refusing to drop his weapon in a Mercer County cemetery Sunday.

Around 6:15 p.m. Sunday, officers with the State Police and Mercer County Sheriff's Department responded to reports of an emotionally disturbed man holding a weapon at Woodlawn Cemetery Mausoleum in Bluewell, according to a press release issued by the West Virginia State Police.

Police say the officers made repeated commands for the man -- identified as 34-year-old Jackie Spalding Jr. -- to show his hands. Instead, police say Spalding reached for his weapon and the trooper fired, fatally wounding the man.

The incident remains under investigation.
